By downloading, installing, or using the Filthy Tone mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
Nature of Service
Filthy Tone is provided free of charge as a courtesy to musicians. There is no warranty, express or implied, regarding the App's accuracy, reliability, or suitability for any particular purpose.
User Responsibilities
You agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, modify, or decompile the App
- Not use the App in a manner that could damage or impair the App's functionality
Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free. You use the App at your own risk.
Limitation of Liability
By using the App, you expressly waive any and all claims against the developer, owner, and affiliates of Filthy Tone for any damages, injuries, or losses arising from your use of the App.
In no event shall the developer be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, even if the developer has been advised of the possibility of such damages.
This includes, but is not limited to, damages resulting from:
- Inaccurate pitch detection or tuner readings
- Audio playback issues or failures
- App crashes, freezes, or performance issues
- Data loss or corruption
- Any decisions made based on the App's output
Indemnification
You agree to indemnify, defend, and hold harmless the developer from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App.
Intellectual Property
The App and all content, features, and functionality are owned by the developer and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent.
Changes to Terms
We may update these Terms of Service at any time. Your continued use of the App after any changes constitutes acceptance of the new terms.
